    Grounds for Divorce in Pennsylvania

    No-fault
    No-fault divorce requires irretrievable breakdown of the marriage; spouses must have either lived separately and apart, without co-habitation, for the past 2 years; or the spouses must have both consented to the divorce and signed and filed affidavits of consent.
    Fault
    Fault grounds for divorce include, but are not limited to, adultery, desertion, extreme cruelty, conviction for a crime and a sentence of at least 2 years' imprisonment, bigamy, and at least 18 months of confinement for a mental disorder with discharge not expected within the following 18 months.

    Requirement
    One spouse must have been a resident of Pennsylvania for at least 6 months before a divorce can be filed.

    Mutual Consent: 90 days
    Unilateral: 2 years
