A Change in Circumstances

A party can petition the court for modification of:

Many common reasons exist to petition the court for modification of an order. However, the court will only grant a modification when a substantial change in circumstances has occurred. This change can involve:
- income: bankruptcy, job loss, job change, increase in income and significantly increased expenses
- child's needs: special educational requirements, disabilities and other exceptional circumstances
Initial Support and Custody Orders
Some support and custody orders contain a clause that states the order cannot be modified. This type of provision can create a significant roadblock in the future if circumstances change and a modification is necessary.
