Alimony Determinations
Unlike spousal support, which is money paid before a divorce is finalized, alimony is the amount paid to a former spouse after a divorce is final. During the course of the marriage dissolution proceedings, but before the divorce is finalized, the support is called Alimony Pendende Lite (APL).
As a general guideline, usually 1 year of alimony is required for every 3 years of marriage. The court uses 18 different factors to determine the amount of payment required, including:
- Earnings
- Length of marriage
- Age
- Health
- Contribution of each party to the marriage
- Custodial arrangement of the children
- Size of marital estate and non-marital assets
