The Long-Term Effects of Alimony

Almost every marriage dissolution negotiations involve some discussion of alimony, which is the money paid from one spouse for the support and maintenance of the other. After the divorce is final, the alimony determination can have a significant impact on your finances for years to come.

Alimony Determinations

Unlike spousal support, which is money paid before a divorce is finalized, alimony is the amount paid to a former spouse after a divorce is final. During the course of the marriage dissolution proceedings, but before the divorce is finalized, the support is called Alimony Pendende Lite (APL).

As a general guideline, usually 1 year of alimony is required for every 3 years of marriage. The court uses 18 different factors to determine the amount of payment required, including:

  • Earnings
  • Length of marriage
  • Age
  • Health
  • Contribution of each party to the marriage
  • Custodial arrangement of the children
  • Size of marital estate and non-marital assets
